Review of Premises Licence for Stop and Shop, 407 Middle Park Way, Havant

Minutes:

The following documents were submitted to the Sub-Committee:

 

(i)         A report from the Licensing Officer;

 

(ii)        Application for a Review of a Premises Licence in respect of Stop and Shop, 407 Middle Park Way, Havant, PO9 5DP

 

(iii)       Statement submitted by Hampshire Constabulary

 

(iv)       Statement and supporting documents submitted by the Licence Holders Solicitor

 

(v)        Statement submitted by the Applicant, Hampshire Trading Standards;

 

(vi)       Notice of Hearing and other Enclosures;

 

The Chairman explained the procedure to be followed at the meeting and confirmed that a permanent record of the proceedings would be kept.

 

All parties agreed to Ms H Goodman, Assistant Solicitor, accompanying the Sub-Committee when it retired to determine the hearings for observation and training purposes only. 

 

The Licensing Officer presented his report to the Sub-Committee and gave an outline of the Application and the representation received.

 

Both parties were invited to make representations to the Sub-Committee in relation to the application.  Both parties responded to members’ questions and were given an opportunity to ask questions of each other.

 

 

The Sub-Committee adjourned from 10.35am until 11.10am

to consider the Application

 

At 11.10 am the meeting was reconvened and the Democratic Services Officer read the decision to the parties.

 

DECISION OF THE LICENSING SUB-COMMITTEE

 

The Sub-Committee took a serious view of any selling of alcohol to underage persons and were particularly concerned that the premises had come to the attention of the Sub-Committee twice within a year.

 

The Sub-Committee had considered the various sanctions available to it and were mindful of the steps the owners had taken since the last Sub-Committee, including the till upgrade following the last failed test purchase, to improve the prevention of the sale of alcohol to persons under the age of eighteen. The Sub-Committee are mindful of the fact that the failed test purchase related to a member of staff who was no longer employed by the owners and a number of test purchases had been undertaken by Trading Standards and a third party which had been successful. It was therefore,

 

RESOLVED  that no further action be taken on this occasion.
